1. Acceptance of Terms

By accessing or using Hello Atmos ("the Service"), you agree to be bound by these Terms of Use. If you do not agree, please do not use the Service. These Terms form a binding contract between you and the Service operator.

2. Who Operates Hello Atmos

Hello Atmos is operated by TAM LABS Sp. z o.o., a limited liability company incorporated under the laws of the Republic of Poland.

3. Description of Service

Hello Atmos is a web application for discovering and rating Dolby Atmos music releases. Core features include:

  • Browsing a catalog of Dolby Atmos albums
  • Rating albums and individual tracks
  • Community rankings and curated "Hidden Gems"
  • Scanning Spotify playlists to identify Dolby Atmos availability
  • Creating Apple Music playlists from discovered tracks

Hello Atmos does not stream, host, or distribute music. All playback happens on third-party platforms such as Apple Music or Tidal.

4. Eligibility

To use Hello Atmos you must:

  • Be at least 16 years of age (or the age of digital consent in your country, whichever is higher)
  • Comply with all applicable laws and regulations
  • Provide accurate information when creating an account

5. Your Account

You sign in using a magic link sent to your email or Apple Sign-In. You are responsible for:

  • Keeping your email account secure (it acts as your password)
  • All activity that occurs under your account
  • Notifying us promptly if you suspect unauthorized access

You may delete your account at any time by emailing support@helloatmos.app.

6. Hello Atmos PRO Subscription

6.1 Plans and pricing

Hello Atmos PRO is offered as a recurring paid subscription:

  • Monthly: US$3.99 per month
  • Annual: US$39 per year (save 18% vs monthly)

Prices are shown exclusive of any applicable taxes, which may be added at checkout based on your country.

6.2 Billing and payment

Payments are processed by Stripe Payments Europe, Ltd. When you subscribe, you authorize us (via Stripe) to charge your chosen payment method for the initial term and for each subsequent renewal term until you cancel. You agree to Stripe's Services Agreement when using the payment flow.

6.3 Automatic renewal

Your subscription renews automatically at the end of each billing period (monthly or annually) at the then-current price. To avoid being charged for the next period, you must cancel before the current period ends. You can cancel at any time via Profile → Manage Subscription, which opens the Stripe-hosted billing portal.

6.4 Cancellation

You can cancel your PRO subscription at any time with no cancellation fee. When you cancel, you retain PRO access until the end of the current billing period; your account then reverts to the free tier automatically. Cancellation does not trigger a refund (see section 6.6).

6.5 Price changes

We may change subscription prices. If we do, we will notify you by email at least 30 days before the change takes effect. If you do not agree with the new price, you can cancel before the change applies. Continued use after the new price takes effect constitutes acceptance.

6.6 Refund policy

All payments are non-refundable. If you cancel, your access to PRO features continues until the end of the current billing period, and no proration or refund is issued for partial periods. If we fail to deliver the service through our fault (e.g., sustained downtime preventing use of paid features), contact support@helloatmos.app and we will assess the situation on a case-by-case basis.

6.7 EU/EEA consumers — Right of withdrawal

If you are a consumer resident in the European Union or European Economic Area, you normally have a 14-day right of withdrawal on distance contracts (Directive 2011/83/EU). Because Hello Atmos PRO is a digital service that begins immediately upon subscription, by starting your subscription you expressly request immediate performance and acknowledge that you lose your right of withdrawal once performance has begun (Article 16(m) of Directive 2011/83/EU, implemented in Poland as Art. 38(13) of the Act on Consumer Rights of 30 May 2014). You can still cancel future renewals at any time as described in section 6.4.

7. Free Tier

A free tier of Hello Atmos is available without payment. Free features are offered "as is" and may change or be discontinued at any time without notice.

8. Third-Party Services

Hello Atmos integrates with third-party services. Your use of these services is subject to their own terms:

We are not responsible for the availability, content, or practices of these third-party services.

9. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with, disrupt, or overload the Service
  • Use automated systems (scrapers, bots) to access the Service in a way that exceeds normal human use
  • Reverse engineer, decompile, or attempt to extract source code from the Service
  • Remove, alter, or obscure any proprietary notices
  • Resell, sublicense, or otherwise commercially exploit access to paid features
  • Create multiple accounts to abuse free-tier limits or promotional offers

10. Intellectual Property

The Service and its original content, features, and functionality are owned by TAM LABS Sp. z o.o. and are protected by international copyright, trademark, and other intellectual property laws. Spotify, Apple Music, Tidal, Dolby Atmos, and other third-party marks are the property of their respective owners. Ratings and reviews you submit remain yours, but you grant us a worldwide, royalty-free license to display them within the Service and to use them in aggregated/anonymized form (e.g., community rankings).

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant:

  • That the Service will be uninterrupted, timely, secure, or error-free
  • The accuracy of metadata, ratings, track matching, or Dolby Atmos availability
  • The availability or quality of content on third-party platforms
  • That any defects will be corrected within a specific timeframe

Nothing in this section limits your statutory rights as a consumer under applicable law.

12. Limitation of Liability

To the maximum extent permitted by law, the Service operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of your use of the Service. Our total aggregate liability to you for any claim arising out of these Terms shall not exceed the greater of (a) the amount you paid us for the Service in the 12 months preceding the claim or (b) EUR 50. Nothing in this section limits liability for death, personal injury, gross negligence, or intentional misconduct, where such limitation is prohibited by law.

13. Termination

We may suspend or terminate your access to the Service (including any active PRO subscription) if you materially breach these Terms, abuse the Service, or if we are required to do so by law. If we terminate an active subscription for reasons other than your breach, we will refund any unused portion of a prepaid period on a pro-rata basis. You may terminate these Terms at any time by canceling your subscription and/or deleting your account.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Poland. Disputes will be resolved by the Polish courts having jurisdiction over the operator's registered office in Warsaw, subject to any mandatory consumer-protection rules in your country of residence that grant you the right to bring proceedings in your local courts. If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. Changes to These Terms

We may modify these Terms from time to time. If a change is material (for example, affecting pricing or your refund rights), we will notify you at least 30 days in advance by email or through an in-app notice. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not accept the changes, you may cancel your subscription and stop using the Service.

16. Communications

By creating an account, you agree that we may send you service-related emails (such as sign-in links and important account or billing notices). These are necessary to operate the Service and cannot be opted out of while your account is active. We may also send occasional product-update emails about new features and relevant content. Every product-update email includes an unsubscribe link, and you can opt out of those at any time without affecting your account or any service-related emails.
